The Association of Medical Laboratory Scientists of Nigeria (AMLSN) has described as untrue the claim by the Nigerian Medical Association (NMA) that the Court of Appeal has confirmed that medical directors are not under any legal obligation to set up the Department of Medical Laboratory Science.
A statement from the association yesterday by the National Publicity Secretary, Ifeanyichukwu Casmir said the “The court never averred as claimed by the NMA that Chief Medical Directors / Medical Directors were not under any legal obligation to set up the Department of Medical Laboratory Science.”
The association also said the Appeal Court did not make reference to the existence of Pathology Laboratory in hospitals nor their headship by pathologists as claimed by NMA.
The Nigerian Medical Association (NMA) had on Wednesday evening issued a statement announcing to all heads of medical institutions and practitioners as well as the public that “the Court of Appeal has confirmed that CMDs/MDs are not under any legal obligation to set up the Department of Medical Laboratory Science in our hospitals aside from the Pathology Laboratories departments headed by qualified pathologists.”
The Association of Medical Laboratory Scientists of Nigeria (AMLSN) said till date, no Nigerian court has set aside any of the judgments in favour of the body of Nigerian Medical Laboratory Scientists working in different public health institutions in Nigeria.
It said the decision of the Court of Appeal, Abuja Division, only had to do with the contempt of court proceedings against the Chief Medical Director, Jos University Teaching Hospital, Professor Edmund Banwat and Mr Ali Bitrus , the Director of Administration in the same hospital.
