COMPLIANCE WITH THE JUDGEMENT OF THE NATIONAL INDUSTRIAL COURT OF NIGERIA (NCIN) ON THE APPOINTMENT OF NON-MEDICAL OFFICERS AS CONSULTANT/PAYMENT OF SPECIALIST ALLOWANCE
Further to the recent judgment of the National Court of Nigeria (NCIN) date4d 22nd july, 2013 concerning the above subject, all Chief Medical Directors and Medical Directors of Federal Tertiary Health Institutions are by this circular requested to comply with the following directives:
All those health workers whose appointment as consultants were withdrawn as a result of directive of the Ministry should be reverted to their former posts pending the outcome of the appeal by the Ministry; All such heakth workers as in (i) above should continue to enjoy approved Specialist Allowances; and iii. In accordance with the Court Ruling, any future appointment to such position is at the discretion of the Ministry;
This circular is deliberately issued to reconcile issues in paragraph 1(iv) of the earlier circular reference No: MH/PM/138/Vol.111/85 dated 18th July, 2014.
It is accordingly necessary to indicate that such designation for discretional appointment referred to in paragraph 1 (iii) above is expected to have been registered by its relevant professional body. The content of this circular is for immediate compliance.
