Land Dispute Tears National Eye Centre, Host Community Apart

There seems not to be the best of time for National Eye Centre, Kaduna and its host community, Mahuta village  as the duo are at loggerheads over ownership of a parcel of land.

In a statement issued and signed  by counsel to Mahuta Community and made available to journalists in Kaduna  Monday  , Mohammed Tanimu  . Mohammed of Falalu Bello and Co Chambers    stated that the residents had taken the matter to court when  the  National Eye Centre encroached  on the land in dispute  in a suit no: KDH/KAD/963/2013 Murtala Abubakar and 9 others  VS  Awwal Tahir and seven others.

According to the counsel to Mahuta residents, the court on March 21 , 2014 finally awarded the land in dispute to the Mahuta community.

However, the defendant,  Awwal Tahir of Interland Skills Limited , who represented National Eye Centre in the case, faulted the judgment  , noting that the land still belongs to National Eye centre. In the statement ,Counsel to the community  Mohammed said,   ” That since the State High court , Kaduna had ruled in Favour of Mahuta community , the judgment stands until set aside by a superior court.

While warning the National Eye Centre and Interland Skills Limited , which  is the firm constructing  a Housing Estate on behalf of  National Eye Centre, the counsel advised   both parties to  respect the court judgement . The statement further read, “Our attention has been drawn to the publications and clandestine activities of Interland Skills Limited , which represented National Eye Centre , Kaduna and Federal Ministry of Land at Mahuta village , adjacent National Eye Centre for Sale.”

” The public must note that except the plots being offered fall within the 1980 acquired land as fully fenced by the National Eye Centre ,neither the  Federal Ministry nor Interland Skills Limited has any title, power or  right to any land in Mahuta village.

” Likewise if 2014 so called measurement in plan no; KD G 1901 refers to 300 hectares outside National Eye Centre , then it is fraudulent , dishonest and must be disregarded by the public.

” All transactions relating to land outside the Eye Centre’s fenced land must be with the people of Mahuta or their lawful attorney/representatives whose title and rights were recognized and affirmed in suit no: KDH/KAD/963/2013 Murtala Abubakar and 9 other  VS Awwal Tahir and seven others”
