Conclusions Reached with JOHESU and the FMOH Meeting Held on 13th March 2014 at the SGFs Conference Room

Conclusions reached with the joint health sector unions (JOHESU) and the Federal Ministry of Health at the meeting held with the secretary to the government of the federation (SGF) on the 13th of March 2014 at the SGF's Conference Room
 
1) Constitution of the Boards of Managements of various tertiary health institutions not done in line with extant law Section 2 (1)c and 2 (1) not observed-
The meeting noted that:
- Some members of JOHESU got their Letters ofAppointment as Board members after the inauguration of the Boards.
- NANNM complained that their own letter was withdrawn and subsequently made out to another person
Federal Ministry of Health was requested to examine the issues and address them adequately

2) Increase in Retirement Age of Health Workers from 60 to 65 years-
JOHESU presented a Position Paper that it had intended to tender at the concluded NCE meeting that was held in Ilorin and the Paper is to be circulated to relevant parties.
The HCSF is to correct the memo to the 12 – man Committee of NCE and also to segregate the issue concerning retirement age as spelt out in the Position Paper prepared by JOHESU. JOHESU was therefore requested to wait for the outcome of the Committee put in place at the National Council on Establishment which had 3 months to complete its work

3) Implementation of 2008 Job Evaluation Report- 
The Unions were informed that Yayale Ahmed Presidential Committee of Experts on Industrial Harmony in the Public Health Sector is on course and its work would include the issue of Job Evaluation

4) Promotion of Officers from CONHESS 14 to 15 as Directors-
a).The Report of the Four (4) Man Committee Constituted to investigate the Allegation of Non-Implementation of Circulars Affecting the Joint Health Sector Unions was endorsed and adopted for implementation at the meeting
b). Federal Ministry of Health was requested to ask for explanations from the defaulting CMD’s and MDs for their failure to attend and/or cooperate with the 4 – Man Committee.
Also, a circular is to be issued by the FMoH to CMDs and MDs on  failure to comply with the Circulars issued on:
Promotion from CONHESS 14 – 15 and
Skipping of CONHESS 10
Circulars should be issued by the FMoH taking cognizance of MOUs reached

5) Circularization of Proper Placement of intern Medical Laboratory Scientists on CONHESS 8 as her counterparts in the Physiotherapy, Pharmacy and Radiography.-
The meeting resolved that where it had been confirmed that the issue of Proper Placement of Intern Medical Laboratory Scientists with the proper bench mark had gone through the process of National Council on Establishment and the Federal Executive Council, the Office of the Civil Service of the Federation should within one month issue a Circular in that regard.

6) Presidential Committee on Harmony in Health Sector-
The Unions were assured that the Yayale Ahmed Committee is on course and urged the Union to be patient

7) Implementation of Skipping of CONHESS 10-
The Report of the Four (4) Man Committee Constituted to investigate the Allegation of Non-Implementation of Circulars Affecting the Joint Health Sector Unions was endorsed for implementation at the meeting www.medicalworldnigeria.com
Federal Ministry of Health was requested to take administrative procedure against CMD’s and MDs who failed to comply with the Circular issued on:
Promotion from CONHESS 14 – 15 and
Skipping of CONHESS 10
Circulars should be issued by the FMoH taking cognizance of MOUs reached

8) Issuance of Circular on Consultancy for other Health Professionals-
Attorney General of the Federation is expected to clarify the term “medically qualified” to aid in understanding the issue of Consultants as contained in the Court judgment. The clarification is to reach the Secretary of the Government of the Federation by 14th March, 2014

9) Issuance of Circular for Payment of Specialist Allowance to Deserving Officers-
The meeting resolved that the Collective Bargaining Agreement of 2009 should be implemented immediately by Federal Ministry of Health

10) Withdrawal of Circular on Deputy CMAC to be reviewed by the Honourable Minister of Health-
The meeting resolved that the issue of the review of the appointment of the post of Deputy CMAC should be stepped down until the outcome of the discussion between the Head of the Civil Service, Secretary to the Government of the Federation and Honourable Minister of Health is known.
It was also resolved that the outcome should be communicated to the Union by the FMoH

11) Collective Bargaining Committee to Review the 2009 Collective Agreement to be set up by the Federal Ministry of Health with the Federal Ministry of Labour and NSIWC as observers-
The meeting unanimously adopted the Report of the Committee. Thereafter parties were requested to examine the document and make their comments available by Monday 31st of March, 2014 2pm at the Secretary to the Government of the Federation Conference room.

12) Proposed Surgeon General-
The Unions were requested not to make an issue out of the matter because the creation of that Office requires amendment of the constitution within the domain of the legislature which would also entail the input of the Unions.
The unions were also assured that Office of the Surgeon cannot be created solely by an Executive fiat.
 
13) Appointment of CMDs/MDs of Teaching Hospitals. Consideration to Permanent Staff of the Hospital rather than University based Personnel-
The meeting resolved that the decision of appointment of CMDs/MDs is dependent on the clarification from the Attorney General of the Federation because of the inclusion of the term “Medically Qualified”. However, the Union argued that the matter was in court and the Attorney General was part of the case and as such the issue of Medically Qualified should not be taken to him for interpretation
The Unions were however urged to await the clarification from the AGF since they equally have options if not satisfied with the clarifications.

14) Advertorial for Appointment of CMD/MDs-
The meeting resolved that the decision of appointment of CMDs/MDs is dependent on the clarification from the Attorney General of the Federation because it includes the term “Medically qualified”.
