C. UNLAWFUL PAYMENT OF SPECIALIST ALLOWANCE
The Joint Health Sector Unions (JOHESU) & Assembly of Healthcare Professionals has continued to express concerns on the above stated subjects and the refusal of some Federal Tertiary Health Institutions (FTHIs) to pay promotion/skipping arrears, as well as embarking on the unlawful payment of Specialist Allowances. These persistent recurrent issues in the Tertiary Health Facilities are worrisome.
I am therefore directed to inform that:
- You offset all your promotion/skipping arrears where such is still pending and to furnish the Federal Ministry of Health with details, as well as the efforts made at promoting members of JOHESU who have been stagnated on a particular salary grade level.
- You are to provide the list of your staff who are benefiting from payment of Specialist Allowance for consideration by the Federal Ministry of Health in line with extant Circulars.
You will recall that these issues were part of the demands made by JOHESU on the Federal Government for which both parties were referred to the Alternative Dispute Resolution (ADR) Centre of the National Industrial Court of Nigeria (NICN). The Federal Ministry of Health has resolved to implement the ADR resolutions that have now become the Judgement of the National Industrial Court of Nigeria (NICN). This is to allow peace to reign in the Tertiary Hospital so as to provide unhindered healthcare services.
I am also to remind that the National Industrial Court of Nigeria (NICN) judgment, Suit No. (NICN/ABJ/238/2012) permitted “skipping" of CONHESS. 10 salary grade level on promotion. This should continue to apply until the determination of the appeal filed by the Federal Ministry of Health.
